  Overview

  This monograph considers the case study of United States v Joseph. In this case, a pharmacist was prosecuted for dispensing a controlled substance that had not been prescribed for a legitimate medical purpose and had not been prescribed in the usual course of professional practice. The pharmacist was tried by a jury along with the prescribing physician and his physician assistant. All three defendants were convicted. The case study provides the opportunity to consider the circumstances in which a pharmacist should know that prescriptions are not being issued according to legal requirements.
