    • Overview

      This monograph presents a case study of United States v Caronia. The key issue in this case is whether the FDA can limit promotional claims by representatives of pharmaceutical manufacturers to the information contained within the approved product labeling. The appellate court, representing only one circuit within the country, has ruled that freedom of speech does not restrict pharmaceutical promotional claims to the content of the product labeling. Rather, the legal standard is that the claims cannot be false or misleading. This monograph considers how a pharmacist can evaluate a promotional claim under this alternative standard.
