  Overview

  This monograph reviews the case study of Kerns v Hoppe, in which a patient's widow sued both the prescriber and the pharmacy, alleging that her husband died from an overdose of medications received from the pharmacy. The case study serves as a vehicle for considering the responsibilities of patients to accept the responsibility for the risk of prescription drug abuse. It questions to what degree prescribers and pharmacists can be held liable for intentional misuse of a medication dispensed to a patient, and whether warnings would be effective when a patient is intentionally abusing medication.
